Post Up Prep™ – Program Terms & Liability Notice

Post Up Prep™ is a referral-based service offered by Post Up Tampa Bay (“PUTB”) and fulfilled exclusively by CXR Solutions (“CXR”), a licensed and insured Florida contractor. By participating in this program or requesting repair services through the Post Up Prep™ form, the client acknowledges and agrees to the following terms:

1. PUTB Is Not the Contractor

All repair, construction, handyman, plumbing, remediation, and build-back services are performed solely by CXR Solutions, who accepts full responsibility for workmanship, permitting, licensing, insurance, scheduling, pricing, and service delivery.

PUTB does not perform repairs, provide construction services, supervise work, or act as a contractor.

2. CXR Is Fully Responsible for the Work

CXR assumes all liability related to:
– Work quality
– Jobsite safety
– Materials and methods
– Estimates, timelines, and project communication
– Compliance with applicable Florida licensing and building codes

All warranties are provided directly by CXR.

3. PUTB’s Role Is Limited to Referral Only

PUTB’s involvement is strictly administrative and promotional.
PUTB does not:
– Create quotes
– Collect payments for repairs
– Guarantee timelines
– Provide warranties
– Make representations on CXR’s behalf

PUTB assumes no liability for losses or damages arising from repair services.

4. Discount & Revenue Share Structure

The Post Up Prep™ discount (10%) is issued solely by CXR and applied directly to CXR invoices.
PUTB’s referral revenue (5%) is paid by CXR and does not increase pricing to the agent or homeowner.

PUTB has no financial responsibility for project costs, overruns, or collection issues.

5. Scheduling, Delays & Access

All scheduling, access arrangements, delays, rescheduling policies, and communication regarding repair services are handled exclusively between the client and CXR.

PUTB is not responsible for missed appointments or timeline changes.

6. No Guarantee of Outcome

PUTB and CXR do not guarantee:
– Inspection outcomes
– Buyer/seller agreement
– Market readiness
– Property condition beyond the scope of completed work

Repairs are limited to the written scope provided in CXR’s estimate.

7. Independent Businesses

PUTB and CXR are independent companies.
This program does not create:
– A joint venture
– A partnership entity
– Shared liability
– Shared employment relationships

Each company maintains its own insurance, financials, and staff.

8. Client Payments & Contracts

All contracts, invoices, payments, change orders, and warranties are executed directly between the client and CXR.

PUTB never handles or processes payments for repair services.

9. Right to Decline Work

CXR reserves the right to refuse or withdraw from projects that:
– Are unsafe
– Fall outside licensing or scope limitations
– Require specialized trades not provided through CXR
– Present unforeseen conditions that materially change the scope

PUTB does not influence acceptance or pricing decisions.

10. Updates to Program

PUTB and CXR may modify or discontinue the Post Up Prep™ program at any time.
Pricing, discounts, timelines, and terms are subject to change with or without notice.
